Shipment and Delivery
All dates quoted by Seller for shipment or delivery are estimated dates only. Seller makes no guarantee and assumes no liability for any delay in shipment or delivery.
30-day Satisfaction Guarantee
If Purchaser is not 100% satisfied with the performance of the product purchased under these Terms, Purchaser may return the product within 30 days of the Seller’s shipment date to Purchaser. Warranties and Limitations of Liability
Seller warrants that the REV33 device only (not the other components included with the order) shall, for one year from the date of shipment, be free from defects in the material and workmanship. SELLER MAKES NO OTHER REPRESENTATION OR WARRANTY OF ANY KIND WITH RESPECT TO ANY PRODUCTS, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE, NOR DOES SELLER MAKE ANY MEDICAL OR PHYSIOLOGIC CLAIMS RELATED TO ANY OF ITS PRODUCTS. IN NO EVENT SHALL SELLER BE LIABLE OR OBLIGATED TO PURCHASER OR ANY THIRD PARTY IN ANY MANNER FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR OTHER INDIRECT DAMAGES OF ANY KIND OR NATURE, (INCLUDING WITHOUT LIMITATION LOSS OF PROFITS OR REVENUES), REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT PRODUCT LIABILITY, OR OTHERWISE, INCURRED BY PURCHASER OR ANY THIRD PARTY AND ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, EVEN IF SELLER WAS ADVISED OF OR OTHERWISE AWARE OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS IN ADVANCE. PURCHASER AGREES THAT PURCHASER IS MAKING USE OF OUR PRODUCTS AT ITS OWN RISK, AND THAT THEY ARE BEING PROVIDED TO PURCHASER ON AN “AS IS” AND “AS AVAILABLE” BASIS. PRODUCTS SOLD AS “USED” OR “SECONDS” OR THE LIKE ARE SOLD “AS IS” WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND.

Jurisdiction and Venue
